Although Probate Code section 8200 requires that the custodian of a Will shall submit it within 30-days after having knowledge of the testator’s death, the Court is not able to enforce this. If the Will is not on deposit but you are certain one was drafted, you may need to contact the attorney who drafted the Will, or check for any safe deposit boxes at the decedent’s bank or personal safes in their home or any other place they may have used to store documents. You may also check with other living relatives or persons who the decedent would have provided the Will to.
